2017 Duck Splash Festival Official Rules

No purchase is necessary to enter or win; open to legal residents of the United States. Void in Puerto Rico and where prohibited by law.

A minimum donation of $5 per duck is requested. Free entries defeat the charitable fundraising purpose of this event and are discouraged. Any person may request one free entry by submitting a written request for such entry and a self-addressed, stamped envelope to Duck Festival, The Arc Montgomery County, 11600 Nebel Street, Rockville, MD 20852, prior to 12:00 pm (EST) on Friday, April 20, 2018.

Odds of winning depend on the total number of qualified entries. A minimum of 5,000 ducks will be included in the duck pluck. Each duck “adopted” by an eligible individual is entered to win any one of the prizes offered. Any and all taxes on prizes or winnings are the sole responsibility of the winner.

Million Dollar Duck: One in every 3,000 ducks in the event will bear a tag number randomly selected before the event by SCA Promotions, Inc. If one of these ducks is the first duck plucked, its adopter will be the potential winner of $1,000,000, subject to verification. If it is not the first duck plucked from the water, the million dollar prize will not be awarded. The $1,000,000 prize, if awarded, will be paid in the form of a forty-year annuity with equal installments of $25,000, without interest. The $1,000,000 prize award is the sole responsibility of SCA Promotions, Inc. SCA Promotions, Inc. and/or The Arc Montgomery County reserve the right to refuse to make the award due to any irregularity in the application of the contest rules. Odds of winning the million dollar prize depend on the number of entries received, combined with the odds of 1:3,000 of a number match.

All potential winners are subject to verification of eligibility by The Arc Montgomery County and of compliance with the promotion rules, including any required documentation, before receipt of the prize. For the Million Dollar Duck, additional verification of eligibility and compliance with the promotion rules may be required by SCA Promotions, Inc. before receipt of the prize. Decisions of The Arc Montgomery County and SCA Promotions, Inc. are final and binding, and no other evidence of a win will be accepted in lieu of their validation process. Positive identification and a completed IRS Form W-9 will be required to claim all prizes. For any winners under the age of 18, a parent or guardian must claim the prize.

Completed adoption papers must be received at The Arc Montgomery County no later than 12:00 pm (EST), Friday, April 20, 2018. The entry portion (including address, phone and email contact information) of the adoption papers must be completed entirely. The Arc Montgomery County is not responsible for entries lost in the mail, incomplete/illegible entries, or entries delivered after this deadline. Online adoptions must be completed by 8:00 pm (EST), Friday, April 27, 2018.

All ducks used in the event will be provided by and remain the property of the GAME, Inc.

Once the ducks are dropped, no attempt to interfere with any duck is permitted, unless deemed necessary by the event judge. Qualified winning ducks will be selected until all prizes are awarded. In case of bad weather or unforeseen circumstances which prevent plucking ducks from their assigned container, winning ducks will be selected randomly using any method dictated by the event judge and winners will be notified by telephone or email.

By participating, participants agree to release, discharge, indemnify and hold harmless The Arc Montgomery County, SCA Promotions, Inc., GAME Inc., and each of its respective officers, directors, employees, representatives, agents, advertising and promotional agencies from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any contest-related activity or participation in this contest.

The winning duck entries will be posted at the conclusion of the event. Winners need not be present at the event. Winners’ names will be posted on this website. All prizes must be claimed from The Arc Montgomery County by 5:00 pm (EST) on Friday, May 11, 2018. If a winner does not claim any prize, The Arc Montgomery County will select an alternate winner through a random drawing of adoption forms.

Acceptance of a prize constitutes permission for The Arc Montgomery County and its agencies to use winner’s name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law.

All decisions and interpretation as to the rules and regulations will be made by the event judge and his/her judgment is final. The Arc Montgomery County is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. All federal, state and local laws and regulations apply.

Participant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the 6th District of Maryland or the appropriate Maryland State Court located in Montgomery County, Maryland; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest but in no event attorneys’ fees; and (iii) under no circumstances will a participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply. Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and The Arc Montgomery County, shall be construed and governed by the laws of the state of Maryland, without regard to conflicts of law rules.
