OFFICIAL RULES AND REGULATIONS OF THE RUBBER DUCK DERBY
Presented by the Boys & Girls Clubs of Lanier, Inc. (the “Presenter”), to benefit the Boys & Girls Clubs of Lanier.
1. Ducks will be launched into Lake Lanier at Clarks Bridge Park at approximately 2:30 p.m. on Saturday, May 16, 2020. The race course will be established by the Presenter and will be approximately 1/10 mile long.
2. All ducks entered will be provided by and shall remain the property of the Presenter.
3.Once the ducks are launched, they are on their own. No attempt to free or interfere with any duck is permitted, unless deemed necessary by the Race Committee. The race course will close 30 minutes after the first duck has crossed the finish line. Any ducks finishing after that time will not be eligible for prizes.
4. A number will be attached to each duck relating to the number on an entry ticket. Multiple duck entries from one ticket will be assigned additional duck numbers for identification. The person's name that appears on the entry ticket corresponding to the first ducks in order of finish will be awarded prizes. A list of prizes can be obtained from the Presenter by sending a written request and a self-addressed stamped return envelope to: Rubber Duck Derby, c/o The Boys & Girls Clubs of Lanier, Inc., P.O. Box 691, Gainesville, Georgia 30503.
5.Presenter reserves the right, at its sole option, to substitute prizes of comparable value.
6.The combined retail value of all prizes will be at least $15,000.
7.The entry portion of each race ticket must be completely filled out and delivered to the Presenter, or an authorized representative of the Presenter, or mailed to the Presenter at the address set forth in paragraph four above and actually received by the Presenter prior to the race for a ticket to be eligible to win any prize. No other tickets are eligible to win any prize. Entrants assume the risk of non-delivery of any entries to Presenter or an authorized representative of Presenter.
8.No purchase is necessary in order to enter or win. Presenter does encourage a donation of $6.00 per entry to benefit the Boys & Girls Clubs of Lanier.
9.Free entry tickets defeat the charitable fundraising purpose of the event and are not encouraged. However, one free entry ticket per person can be obtained by presenting a handwritten request in person between the hours of 1:00 p.m. & 4:00 p.m. Wednesday and Thursday (except holidays) at the Presenter's address listed in paragraph four above and submitting therewith a self-addressed, stamped return envelope for mailing of the entry ticket. Due to limited staffing, call to verify assistance availability before going. Requests for free entry tickets made after 4:00 p.m. on May 1, 2020 or after 13,000 ducks have been adopted, will not be honored. Entry tickets in exchange for a $6.00 donation each can be obtained from any member of the Presenter, from any participating point of purchase display stand and from other sources authorized by Presenter.
10.Winners will be announced following the race - on location - on Saturday. Entrants will, where necessary, also be notified by United States mail email or by telephone. Race winners need not be present to win. A list of race winners can be obtained from the Presenter by sending a written request and a self-addressed, stamped return envelope to Presenter at the address listed in paragraph four above. If any race winner does not claim his or her prize from Presenter at the address listed in paragraph four above within 30 days after May 16, 2020, the Presenter will select a substitute winner through a random drawing of entry tickets.
11.Each winner has sole responsibility for paying any and all taxes and similar fees on any prize(s) won and must authorize the deduction of such taxes, if any, from the prize(s) to the extent required by law. No cash equivalent prizes will be provided in lieu of the designated prizes.
12.By entering, entrants release the Presenter and its members, directors, agents, employees, and other related entities from any and all liability with respect to prizes.
13.By entering, winners consent to promotional use of their names and likeness without additional compensation.
14.Chances of winning depend on the total number of qualified entries.
15.This event is subject to all federal, state and local laws and regulations and is void where prohibited by law.
16.The conduct of the race, the determination of race winners and the random drawing for additional prizes will be audited and verified by a representative of an independent accounting firm. All decision and interpretations of rules and regulations will be made by the Presenter and its judgment is final.
17.The Rubber Duck Derby and its logo are registered trademarks of the Presenter and no other person or entity is authorized to copy or otherwise use them without the Presenter's express written consent.
18.A copy of these rules and regulations is available from the Presenter at the address listed above.
19.If the Presenter determines, in its sole discretion, that the race cannot occur at the scheduled time for any reason, then the Presenter can postpone the race to another date and time by public announcement thereof.
